Canopy Study recognises that its customers, visitors, users, and others who use this website value their privacy.

This Privacy Policy applies to the collection and use by Canopy Study (“we" or “us" or “our”) of personally identifiable information (“PII”) that identifies or permits contact with a specific person, such as full name or email address  in connection with your use of this website (“Service”). It also describes Canopy Study’s practices for handling non-personal information (e.g site activity) in connection with the Service. By providing personal information to us or using the Service, you agree to the terms and conditions of this Privacy Policy. If you do not agree to this Privacy Policy, please discontinue your use of the Site.

FERPA

The Family Educational Rights and Privacy Act (FERPA) was enacted by Congress to protect the privacy of students and their parents. The act is designed to ensure that students and parents of students may obtain access to the student’s educational records and challenge the content or release of such records to third parties. Collection of Your information 

Canopy Study will only collect data necessary to fulfil its duties as outlined in this Policy. 

General visitors may provide us with PII such as their name and email address when contacting us to learn more about our Service. 

Registered users of our Service (excluding students), such as teachers, teaching assistants and other staff members, may provide us with their first and last name, and email address. However, you may be required to provide certain personal information to us when you elect to use certain products or services available on the site. These may include: (a) registering for an account on our site; (b) sending us an email message; (e) submitting your credit card, billing address and full name when purchasing an upgraded subscription.

Registered students of our Service may provide us with their first and last name, and email address. Canopy Study does not request any other PII. 

Visitors can always refrain from supplying certain information, but it may prevent them from engaging in certain services which require that information.

How we collect your personal information 

Canopy Study collects personal information from you in a variety of ways, including when you interact with us electronically or in person, when you access our Service and when we provide our services to you. We may receive personal information from third parties. If we do, we will protect it as set out in this Privacy Policy. 

Use of your personal information 

Canopy Study does not collect, maintain, use, or share student personal information beyond that needed for authorised educational/school purposes, or as authorised by the parent/student. We do not sell student data under any circumstances, even with consent. We do not create or keep student profiles for non-educational purposes.

Canopy Study may contact you by a variety of measures including, but not limited to email. In the case it is unwanted, you can use the unsubscribe link found at the bottom of the email to opt out of receiving future emails.

Access to your personal information 

Schools, parents, teachers, students or the entity the student is part of, may ask to review the information that Canopy Study has collected and retained about said student, as well as request its deletion by contacting us at support@canopy.study

Disclosure of your personal information 

We may disclose your personal information to any of our employees, officers, insurers, professional advisers or agents insofar as reasonably necessary for the purposes set out in this Policy. Personal information is only supplied to a third party when it is required for the delivery of our services. 

We may from time to time need to disclose personal information to comply with a legal requirement, such as a law, regulation, court order, subpoena, warrant, in the course of a legal proceeding or in response to a law enforcement agency request. 

We may also use your personal information to protect the copyright, trademarks, legal rights, property or safety of Canopy Study, our Service, its customers or third parties. 

Information that we collect may from time to time be stored, processed in or transferred between parties located in countries outside of Australia. 

By providing us with personal information, you consent to the terms of this Privacy Policy and the types of disclosure covered by this Policy. We do not sell or disclose your PII to nonaffiliated parties except in connection with our services and the operation of our business as explained in this policy and our terms of service.  

Security of your personal information 

Canopy Study takes user privacy and data security seriously. We use commercially reasonable, industry standard measures to safeguard personal information in its possession against loss, theft, unauthorised use, or disclosure. Steps taken to secure student data include the following:

Any sensitive online information is transmitted over secure, encrypted channels via HTTPS. Sensitive information is not transmitted over email.

All student data are stored on secure servers utilising firewall technology and are only accessible via HTTPS and with proper authentication.

If student data needs to be copied to a local machine for providing customer support, the data is always password protected, and is immediately deleted from the local machine upon completion of the support task.

Canopy Study does not share student information with any third parties. If a school/company requests that student data should be sent to a third party, Canopy Study sends the data to the school/company and never directly to the third party.

Data Breach Response

In the event Canopy Study discovers or is notified of a data breach, we will, as required by applicable federal and state laws, investigate, take steps to mitigate the potential impact, and provide notice of the breach to applicable agencies, and customers. However, despite our efforts, no security measures are perfect and we assume no responsibility for any breaches.

Canopy Study maintains a written Information Security Policy which details specific steps the company will take in the event of a data breach to validate the breach, end the breach, and notify affected parties, as appropriate.

Information obtained when using our Service

Browser or device information which is collected through your device, such as Media Access Control (MAC) address, computer type (Windows or Macintosh), screen resolution, operating system name and version, device manufacturer and model, language, internet browser type and version of the Services you are using.

Usage data which is collected whenever you interact with our Service. This may include the dates and times you access the Services and your browsing activities (such as what portions of the Service you used). We also collect information regarding the performance of the Services, including metrics related to the deliverability of emails and other communications you send through the Service. If you are using our Service, we may collect information about how often you use the Service and other performance data. This information allows us to improve the content and operation of the Service and facilitate research and analysis of the Service.

Log data whereby our web servers keep log files that record data each time a device accesses those servers and the nature of each access, including originating IP-addresses and your activity in the Services. We may also access metadata and other information associated with files that you upload into our Service.

Our site may from time to time have links to other Websites or Apps not owned or controlled by us. These links are meant for your convenience only. Links to third party Websites or Apps do not constitute sponsorship or endorsement or approval of these Websites or Apps. Please be aware that Canopy Study is not responsible for the privacy practices of other such Websites or Apps. We encourage our users to be aware, when they leave our App, to read the privacy statements of each and every Website or App that collects personal identifiable information.

Retention of Data

Canopy Study will retain your personal information only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your personal information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolves disputes and enforce our legal agreements and policies

Canopy Study will also retain usage data for internal analysis purposes. Usage data is generally retained for a shorter period of time, except when this data is used to strengthen or to improve the functionality of our Service, or we are legally obligated to retain this data for longer periods.

Our Policy to Children 

All account holders agree that they have obtained the consent or authorisation for any user under the age of 18 to use and access the Service.

If we discover we have inadvertently collected Information from a person under 18 years of age without consent from the account holder and/or a parent or guardian, the Information will be deleted immediately. If we are required to do so by law, we will pass details of the collection of Information to the relevant authorities.

Transfer of Assets

In the event of any acquisition, reorganisation or merger of Canopy Study or its assets, your information may be transferred as part of the transaction to an assignee. The assignee will assume and be subject to the same obligations of the Terms of Use and this Privacy Policy as Canopy Study. You acknowledge that such transfers may occur, and that any acquirer of Canopy Study may continue to use the information you provide to us as set forth in this Privacy Policy and in our Terms of Use. In the unlikely event that the likelihood of us going out of business or entering bankruptcy is imminent, we will provide you with thirty (30) days’ notice to use the Service and after such 30 days all data will be transferred to the assignee.

If you have any complaints about our privacy practices, please feel free to send in details of your complaints to support@canopy.study. We take complaints very seriously and will respond shortly after receiving written notice of your complaint. 

Changes to Privacy Policy 

Please be aware that we may change this Privacy Policy in the future. We may modify this Policy at any time, at our sole discretion and all modifications will be effective immediately upon our posting of the modifications on our Service or notice board. We will notify you via e-mail at the last email address you have provided to us. If you do not agree with any changes to the Privacy Policy, you may terminate your account and stop using our Service. Your continued use of our Service after the revised Privacy Policy has become effective indicates that you have read, understood and agreed to the current version of the Privacy Policy.
